3. Intellectual Property
Unless otherwise agreed in writing, all source code, design assets, and intellectual property developed by Cyberaks remain the property of Cyberaks until full payment is received.
Upon payment completion, ownership of final deliverables will be transferred to the client, excluding any third-party materials, frameworks, or open-source components used in the project.
4. Payments
All fees and payment terms are agreed upon prior to project initiation. A deposit may be required to begin work.
Payments are non-refundable once work has commenced unless otherwise stated in a signed agreement.
5. Client Responsibilities
Clients must provide accurate project information, content, and feedback in a timely manner. Delays in communication or approvals may affect delivery timelines.
Cyberaks is not responsible for issues arising from incomplete or incorrect information provided by the client.
6. Confidentiality
Cyberaks respects client confidentiality. All client data, project details, and communications will be kept private and will not be shared with third parties without written consent, except as required by law.
7. Limitation of Liability
Cyberaks will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
We do not guarantee uninterrupted operation of websites or applications once delivered, especially when hosted or modified by third parties.
8. Third-Party Services
Cyberaks may integrate or recommend third-party tools or services (such as hosting providers, APIs, or plugins).
We are not responsible for the functionality, reliability, or updates of these third-party services.
9. Termination
Either party may terminate a project agreement in writing. In such cases, all completed work up to the termination date must be paid for, and all rights to unfinished work remain with Cyberaks unless otherwise agreed.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Thailand. Any disputes shall be resolved under Thai jurisdiction.
11. Updates to Terms
Cyberaks reserves the right to modify these Terms and Conditions at any time. Updates will be reflected on our website with a new effective date.
